1. GENERAL TERMS REGARDING THE RIGHT OF WITHDRAWAL AND RETURNS

As a consumer, you may have the right to withdraw from a purchase agreement within a specified period without giving any reason. Which rights apply and how long the period is depend on which market and legislation apply to the purchase.

Your mandatory rights under applicable consumer legislation are not affected by this return and right of withdrawal policy.

The webshop is operated by Noctura Commerce Limited under the brand ScandiSpirit.

For customers in Norway, the rules of the Right of Withdrawal Act apply, among others.

For customers in the United Kingdom, the relevant rules under UK consumer legislation apply.

For customers in other markets, the mandatory consumer rights that follow from the legislation applicable to the respective market apply.

In addition to the statutory right of withdrawal, ScandiSpirit offers an optional 30-day right of return. The optional right of return is additional to and does not limit your statutory rights. The optional right of return applies in accordance with the terms described in this policy.

2. RIGHT OF WITHDRAWAL FOR CUSTOMERS IN NORWAY

As a consumer, you have the right to withdraw from the purchase agreement without giving any reason within 14 days of receiving the goods.

The withdrawal period starts from the day after you or a person you have designated (who is not the carrier) takes physical possession of the goods.

If the order is delivered in multiple shipments, the withdrawal period starts from the day after you receive the last item.

In addition, ScandiSpirit offers an optional 30-day right of return. The optional right of return is additional to the statutory right of withdrawal and gives you an extended opportunity to return the goods, in accordance with the terms of this policy.

To exercise the right of withdrawal, you must send us a clear notification that you wish to withdraw from the agreement before the withdrawal period expires. You may use the withdrawal form below, but it is not mandatory. You can also send us another clear statement that you wish to exercise the right of withdrawal.

3. RETURN OF THE GOODS

When you have notified us that you are exercising the right of withdrawal, the goods must be returned without undue delay and no later than 14 days after you notified us of your wish to withdraw from the agreement, unless otherwise required by applicable legislation.

When using ScandiSpirit's optional 30-day right of return, you must contact us within 30 days of receiving the goods. After you contact us, we will provide you with information on how and within what deadline the goods must be returned.

Do not send the goods to the company's registered business address unless we have explicitly asked you to do so.

As a general rule, you are responsible for the direct costs of the return, unless we have agreed otherwise with you or applicable legislation requires us to cover the costs.

You may examine and handle the goods to the extent necessary to determine the nature, characteristics, and function of the goods. If the goods are handled beyond what is necessary, we may claim compensation for any reduction in value to the extent permitted by applicable legislation.

4. REFUND

When you exercise the right of withdrawal, we will refund the payments we have received from you, including the cost of the cheapest standard delivery we offer, to the extent this is required by applicable legislation.

If you have explicitly chosen a more expensive delivery method than our cheapest standard delivery, the extra cost of this choice will not be refunded, to the extent permitted by applicable legislation.

The refund will be made without undue delay and within the deadline set by applicable legislation.

For customers in Norway, the refund will be made no later than 14 days after we have received the notification that the right of withdrawal is exercised, subject to the right to withhold the refund in accordance with applicable legislation.

We may nevertheless withhold the refund until we have received the returned goods, or until you have documented that the goods have been sent back, whichever occurs first, to the extent this is permitted by applicable legislation.

The refund is normally made using the same payment method that was used for the original purchase, unless otherwise explicitly agreed with you. We do not charge any fees for the refund.

When paying by card or other electronic payment method, the refund may be processed through the same payment provider or payment method that was used for the original purchase.

When using the optional 30-day right of return, the refund is made after the return has been received and checked, in accordance with the terms of the optional right of return.

5. CUSTOMERS IN THE UNITED KINGDOM

For customers in the United Kingdom, the statutory rights under UK consumer legislation apply.

For online purchases, you normally have the right to cancel the purchase within 14 days of receiving the goods, without giving any reason.

After you have notified us that you wish to cancel the purchase, you normally have an additional 14 days to return the goods.

In addition, ScandiSpirit offers an optional 30-day right of return. This is additional to the statutory rights and does not affect your rights under UK consumer legislation.

When using the optional 30-day right of return, you must contact us within 30 days of receiving the goods. After you contact us, we will provide you with information on how and within what deadline the goods must be returned.

We will refund the payments you have made, including the cost of standard delivery, in accordance with applicable UK rules. If you chose a more expensive delivery method, we do not need to refund the extra cost of this to the extent permitted by law.

The refund is processed in accordance with applicable UK rules and normally within 14 days of us receiving the returned goods or documentation proving that the goods have been sent back.

When using the optional 30-day right of return, the refund is made after the return has been received and checked, in accordance with the terms of the optional right of return.

You may handle the goods to the extent necessary to examine them in the same way you would normally do in a physical store. If the goods are used or handled beyond this and this has reduced their value, a deduction may be made from the refund to the extent permitted by law.

6. CUSTOMERS IN OTHER MARKETS

If we offer sales and delivery in other countries or markets, the mandatory consumer rights that follow from the legislation applicable to the respective purchase apply.

This policy shall not be construed as a limitation of such statutory rights.

In addition to any statutory rights, ScandiSpirit offers an optional 30-day right of return, unless otherwise explicitly stated for the respective market.

If local legislation grants consumers rights that are more favorable than the rules described here, the mandatory local rules apply.

7. TERMS OF THE OPTIONAL 30-DAY RIGHT OF RETURN

The optional 30-day right of return is additional to your statutory rights.

To exercise the optional right of return, you must contact ScandiSpirit within 30 days of receiving the goods.

The goods must be in a condition that allows them to be returned in accordance with the terms applicable to the optional right of return. If the goods are used, damaged, or handled beyond what is necessary to examine them, this may affect the possibility of exercising the optional right of return or the size of any refund, to the extent permitted by applicable legislation.

Always contact us before sending the goods back. We will provide you with the correct return address and return instructions.

The optional right of return does not affect your statutory rights if the goods have defects or faults, or if you have another statutory right to withdraw from the agreement.

8. EXCEPTIONS FROM THE RIGHT OF WITHDRAWAL

The right of withdrawal does not apply in cases where applicable legislation explicitly exceptions the right of withdrawal.

This may include:

• goods produced according to the customer's specifications or that have a clear personal character
• goods that due to their nature deteriorate quickly
• sealed goods that, for health or hygiene reasons, are not suitable for return if the seal is broken after delivery
• other goods or services covered by a statutory exception from the right of withdrawal

Any exceptions apply only to the extent they follow from applicable legislation.

9. GOODS WITH DEFECTS OR FAULTS

The right of withdrawal must not be confused with your statutory rights if the goods have a defect, are damaged, do not conform to the agreement, or otherwise do not meet the requirements applicable under the law.

If you receive goods with a defect or fault, please contact us at support@scandispirit.com, so we can assist you with the matter.

Your statutory rights regarding defects, faults, or damages are not affected by this return and right of withdrawal policy.

10. VOLUNTARY RESOLUTIONS

In some cases, we may voluntarily offer another solution, for example that you keep the goods and receive a partial refund or a discount code.

Such a solution is voluntary and offered in agreement with the customer. It does not affect your statutory rights.

If you wish to exercise a statutory right of withdrawal, the rules applicable to the respective market apply.
